FIGHTING BLINDNESS TERMS OF USE

General Terms of Use
By using this site you signify your agreement to these Terms of Use, which take effect on the date of your first use of the site. If you do not agree to the Terms of Use set out below, please do not use the site. Fighting Blindness reserves the right to add to or change the terms of this agreement. It is your responsibility to refer to and comply with these terms on accessing the Fighting Blindness website. You agree to use this site for lawful purposes only, and in the manner which does not infringe the rights of any third party nor inhibits the enjoyment and use of this site by any third party. You agree to abide by all applicable laws, regulations and codes of conduct and to be solely responsible for all things arising from your use of the Fighting Blindness site. You agree to provide true, accurate, complete and current information, where required, and to notify us immediately of any change. If there is a conflict between these Terms of Use and the rules and/or specific terms of use appearing on this site relating to specific material then the latter shall prevail. If any provision of these Terms of Use shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions. These terms and conditions of use shall be constructed and interpreted in accordance with Irish Law. The Courts of Ireland shall have exclusive jurisdiction in relation to any claim, dispute or other matter arising there-from.

Personal Use Only
Fighting Blindness services are made available for your personal, non-commercial use only. You may not, for example, copy search results from Fighting Blindness and reformat and display them on your website, or send automated queries to the Fighting Blindness database without receiving express permission to do so from Fighting Blindness. If you want to make commercial use of the Fighting Blindness services you must first enter into an agreement with Fighting Blindness to do so. Fighting Blindness will be happy to facilitate non-commercial use of the resource by organisations within the Community & Voluntary Sector in Ireland. Fighting Blindness makes every effort to ensure that links included on the Fighting Blindness website refer to electronic resources of relevance to visual impairment. However, Fighting Blindness exercises no control over third party sites, their content or how they are amended. Fighting Blindness cannot therefore make any representations or warranties about the content of these sites, the opinions expressed in them or the activities of their publishers. We furthermore cannot guarantee that a search result returned from Fighting Blindness will not locate unintended or objectionable content and assume no responsibility for the content of any site linked to by Fighting Blindness.

Fighting Blindness disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or material displayed on the Fighting Blindness website. Fighting Blindness further disclaims any responsibility for any harm resulting from downloading or accessing any information or material on the Internet through the Fighting Blindness website. The Fighting Blindness services are provided "as is", with no warranties whatsoever. Fighting Blindness expressly disclaims to the fullest extent permitted by law all express, implied, and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. FIGHTING BLINDNESS PRIVACY POLICY

Fighting Blindness, the publisher of www.fightingblindness.ie, is committed to protecting your privacy. We have adopted this Privacy Policy to let you know how your personal information is processed and used. We promise that we will take steps to use your personal information only in ways that are compatible with this Privacy Policy. The following policies are only in effect for web pages, newsletters, discussion lists and opt-in announcement lists owned and operated by Fighting Blindness.

What information are we collecting and how are we collecting it?

When a visitor requests a page from the Fighting Blindness website, our web servers automatically recognise that visitor's domain name and IP address. What are cookies?

What other information do we request?

Fighting Blindness reserves the right to transfer information in connection with the sale of all or part of the capital stock or assets of Fighting Blindness. Furthermore, we are not responsible for any breach of security or for any actions of any third parties who receive the information. Fighting Blindness has links to a wide variety of other sites. We are not responsible for their privacy policies or how they treat information about their users. Please note that Fighting Blindness will release specific personal information about you if required to do so in order to comply with any valid legal process such as a search warrant, subpoena, statute, or court order.

Your Consent To This Agreement
By using the Fighting Blindness website, you consent to the collection and use of information by us as specified above. FIGHTING BLINDNESS INTELLECTUAL PROPERTY RIGHTS POLICY

Fighting Blindness respects the intellectual property of others, and expects all users of and contributors to the Fighting Blindness website to do the same. [Fighting Blindness may, in appropriate circumstances and at its discretion, terminate the accounts of users who infringe the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Fighting Blindness with the following information:

  • a description of the copyrighted work that you claim has been infringed;
  • a description of the location on the Fighting Blindness site of the material that you claim is infringing copyright;
  • your contact details - address, telephone number and email address;
  • a signature of the person authorised to act on behalf of the owner of the copyright interest;

Fighting Blindness users and contributors must only transmit copyrighted works to or through www.fightingblindness.ie, with the express written permission of the copyright holder or in accordance with the fair use provisions of copyright law. All reproductions of works in part or whole should be clearly identified. The author, copyright holder, original source, title, copyright statement, and, in the case of materials obtained from the Internet, the URL of the material being reproduced, must be included in the citation. Fighting Blindness considers posting to Fighting Blindness discussion groups to be a form of "publication" and users of such services must therefore comply with the terms of this intellectual property notice. Contributors or users who contribute reviews, articles, messages and other materials that have been commissioned by Fighting Blindness will on some occasions assign copyright to the publisher of the Fighting Blindness in return for financial consideration.
